📋 At a glance
These Terms of Use (ToU) constitute a binding agreement between ANSWIFY and you, the User of the Answify mobile application. By accessing the application and using the Services, you agree to be bound by this agreement. They are governed by Belgian law.
Answify may modify these Terms at any time and will inform you via the app or by email. Your continued use constitutes acceptance of the modifications.
Definitions
The following terms, when capitalized, have the meanings below:
- Account: your Answify account
- Agreement: these Terms of Use along with the annexed Policies
- ANSWIFY / we: company incorporated under Belgian law, registered office to be completed, registered with the Crossroads Bank for Enterprises under no. (pending)
- Application: the Answify mobile application
- App Store: Apple App Store or Google Play Store
- Content: any material, data, information or functionality provided by Answify via the Services
- External Services: websites, applications and platforms belonging to Third Parties (including Facebook and Instagram)
- Facebook: Facebook and Messenger
- Fees: the applicable rate for using the Services, as indicated in the App Store
- Force Majeure: any unforeseeable, unavoidable event beyond Answify's control
- Indirect Damages: financial or commercial losses, loss of profit, damage to brand image, data loss, which are not the immediate consequence of a breach by Answify
- Input Data: any content collected on your Facebook/Instagram pages (messages, comments, replies) or provided by you in connection with the Services
- Intellectual Property Rights: copyrights, patents, trademarks, designs and models, database rights, trade secrets, and all similar rights
- Intended Purpose: the automatic generation of suggested replies to messages and comments on your Facebook and/or Instagram pages
- Linked Services: External Services to which Content or Input Data may be submitted (including Facebook and Instagram)
- Subscription Period: the period during which the Agreement is in force
- Tool: the artificial intelligence tool used to provide the Services
- User: any party having subscribed to the Services in accordance with the Agreement
Description of Services
The application offers a service that automatically generates suggested replies to messages received in your Facebook/Instagram inbox and to comments published on your Facebook and/or Instagram pages.
To use the Services, you must connect the Facebook and/or Instagram account(s) for which you wish to benefit from the service.
The Services automatically identify new messages/comments and generate a suggested reply for each. These suggestions are only visible to you in the application — they are not sent/published automatically without your intervention.
When a suggestion is generated, you have three options:
- Send/publish it as is
- Request the generation of a new suggestion (up to 2 times)
- Edit the suggestion before sending/publishing it
The application is available in English and French.
Your Answify Account
4.1 Account creation
The Services are provided in connection with the Facebook and/or Instagram account(s) you choose to connect. By registering, you acknowledge being responsible for complying with Facebook and Instagram's terms of use.
4.2 Paid access
Access to the Services is subject to the payment of Fees in accordance with Section 6.
4.3 Free trial period
You may benefit from a free trial period, the duration of which is indicated in the application. This period cannot be interrupted. Upon its expiration, access will cease unless a paid subscription is started. If no subscription is started, your data will be deleted within a month of expiration.
4.4 Legal capacity
You declare that you have the legal capacity to enter into a contract and, if representing a company, that you are duly authorized to act on its behalf.
4.5 Account security
You are responsible for keeping your credentials and passwords confidential. A user account is strictly personal and may not be shared.
4.6 Account compromise
In the event of loss, theft, or unauthorized access to your account, you must inform us immediately at contact@answify.com and change your password as soon as possible.
4.7 Suspension or closure by Answify
Answify reserves the right to suspend or close your account in the event of a breach of the Agreement, infringement of third-party rights, or non-compliance with applicable laws.
Term and Renewal
The Agreement is initially concluded for a Subscription Period of one (1) month. It automatically renews for successive one-month periods unless you close your account at least 7 days before the start of the next Subscription Period.
In the case of a free trial, the Agreement is concluded for a period of one (1) month, without automatic renewal.
Pricing, Payment, and Billing
The amount of the Fees is set in the App Store. The applicable price is the one displayed at the time of purchase.
Answify reserves the right to modify its pricing schedule at any time. Modifications will be notified to you via the application and will be applicable starting from the next Subscription Period.
Payment is made directly to the App Store, in accordance with their terms of use:
- Apple App Store: apple.com/legal/internet-services/itunes
- Google Play Store: play.google.com — Terms of Service
The security of fund transfers is the sole responsibility of the payment service provider of the relevant App Store.
Use of the Tool and Services
The Services must be used in good faith and in accordance with acceptable standards of behavior. The reply suggestions generated by the AI must be subject to human review, for which the User is solely responsible. The Services do not include compliance checks with applicable laws.
You agree to use the Tool in accordance with its Intended Purpose, excluding any other use, and not to transform it into a high-risk AI system within the meaning of the European AI Act (Regulation EU 2024/1689).
Without our prior written consent, you may not aggregate Content from the Services into a separate destination that would substantially replicate the offering of the Services.
Input Data
8.1 Data quality
To provide the Services, we require sufficient, accurate, and appropriate information about your business, products/services, and communication style. The quality of the Services depends on this. You are responsible for providing us with this information in a timely manner.
8.2 Storage
The application and the Services are not designed to store Input Data.
8.3 Responsibility for Input Data
You are solely responsible for the accuracy, completeness, and appropriateness of the Input Data. You agree to indemnify Answify against any third-party claims related to the Input Data.
8.4 Linked Services
Once Input Data is transmitted to a Linked Service (Facebook, Instagram), it is no longer under Answify's control.
8.5 License granted to Answify
You grant Answify a worldwide, non-exclusive, royalty-free license to use the Input Data for the purpose of improving the quality of the Services.
8.6 Prohibited content
Input Data may not:
- Be illegal, abusive, defamatory, pornographic, or obscene
- Promote or incite hatred, violence, terrorism, or discrimination
- Be contrary to the Agreement or to applicable local, national, and international laws
Intellectual Property
The Services and the generated reply suggestions are the property of Answify. By entering into the Agreement, Answify grants you a personal, limited, non-exclusive, non-transferable, and non-sublicensable license to use the Services and the generated suggestions.
You are strictly prohibited under any circumstances from:
- Copying, selling, assigning, distributing, renting, or reproducing the Services or any part thereof
- Adapting, modifying, decompiling, disassembling, or reverse-engineering the Services
- Removing copyright notices, trade secrets, or confidentiality warnings
- Using the Services for purposes other than those authorized by the Agreement
Liability
10.1 Best efforts obligation
Unless expressly stated otherwise, Answify's obligations are best-effort obligations. Answify makes its best efforts to ensure the proper functioning of the Services, but these may be temporarily unavailable for technical reasons.
10.2 Exemption cases
Answify shall not be held liable in the event of damages caused wholly or partly by third parties, in particular: interruption of electronic communication services, cloud infrastructure outages, unauthorized intrusions, viruses, or fraud attempts.
10.3 Exclusion of warranties
The Services are provided "as is". Answify does not guarantee the accuracy or completeness of the suggestions; the continuity or error-free nature of access to the Services; or hardware and software compatibility.
10.4 Limitation of liability
Answify shall not be held liable for any loss, damage, or expense arising in particular from: modifications made to the Services, suspension of access, third-party actions, data loss, security breaches, or Force Majeure.
10.5 Indemnification
You agree to defend and indemnify Answify against any claim resulting from your access/use of the Services or any violation of the Agreement.
10.6 Liability cap
Maintenance
Answify may adapt and improve the Services. The User accepts that certain features may be removed or added without being able to claim any right to any of them.
To the extent possible, Answify will inform the User of significant changes by email or via the application, and will strive to limit interruptions due to maintenance operations.
Third-Party Services (External Services)
The Services are used in connection with External Services, notably Facebook and Instagram. Answify has no control over these External Services and is not responsible for their content, operation, or use.
External Services are governed by their own terms of use. You are solely responsible for verifying these terms.
Personal Data
13.1 Processing of User data
Answify processes personal data relating to its Users in accordance with the Privacy Policy. For any questions: contact@answify.com
13.2 Processing of third-party data on behalf of the User
Answify may process personal data relating to third parties on your behalf (as a processor). These third parties include individuals who send you messages on Facebook/Instagram and post comments on your pages.
You guarantee to process the personal data of these third parties in compliance with applicable data protection laws.
Modifications to Services, Content or Accounts
Answify may, at any time and without obligation to provide reasons or notice, upgrade or modify the Services, temporarily or permanently, in whole or in part.
In the event of a substantial reduction in functionality, you will be informed. If this reduction is an issue for you, you are authorized to cancel your current Subscription Period and will be refunded the Fees on a pro-rata basis.
Termination and Expiration
15.1 Automatic renewal
The Agreement automatically renews unless you close your account at least 7 days before the start of the next Subscription Period.
15.2 Termination by Answify
Answify may terminate the Agreement with immediate effect in case of breach of the Agreement, or at any time with 7 days' notice via the application.
15.3 Consequences of termination
Upon expiration or termination of the Agreement, your account will be deactivated, and all rights and licenses will cease immediately. In the event of termination for a breach on your part, you are not entitled to a refund of the Fees.
15.4 Input Data after termination
Once your account is terminated, all Input Data residing in your account will be irreversibly deleted within a reasonable time, subject to legal retention obligations.
Miscellaneous
16.1 Electronic documents
The parties accept electronic documents and notifications via the application as binding written evidence.
16.2 Subcontracting
Answify reserves the right to delegate or subcontract its obligations to reputable third parties.
16.3 Assignment
You may not assign your rights or obligations without Answify's prior written consent. Answify may assign its rights and obligations to any third party, particularly in the event of an asset sale or acquisition.
16.4 Severability
The invalidity or unenforceability of a clause does not affect the validity of the remaining clauses.
16.5 Non-waiver
The failure of Answify to enforce any provision of the Agreement does not constitute a waiver of its rights.
16.6 Entire agreement
This Agreement constitutes the entire agreement between the parties regarding the use of and access to the Services, and supersedes any prior agreement or representation.
16.7 Language
The Agreement is drafted in English. Only the English version is authentic.
16.8 Waiver of right of withdrawal
Given the nature of the Services and the distance contract conclusion, you expressly acknowledge requesting immediate access to the Services and waiving your right of withdrawal in accordance with Articles VI.45, 11°, and VI.53, 1°, of the Belgian Code of Economic Law.
